Woman gives birth in Subway restroom in Nevada

(AP) ? It was just another day at work for Flora Vargas until a screaming woman burst into her Subway sandwich shop in Nevada on Friday and announced she was in labor.

After the pregnant woman raced for the women's restroom, assistant manager Vargas and her boss sprang into action, placing sandwich wrappers and trash bags on the floor for sanitation.

With Vargas' help, the mother gave birth on the restroom floor in Minden, 40 miles south of Reno, a couple minutes later.

"It was a boy. A beautiful boy," Vargas told The Associated Press. "He didn't cry when he came out. Then he cried, and I breathed easier knowing he was alive."

No customers were in the restaurant at the time of the 9:30 a.m. birth, but the restaurant was open. The only employees inside were Vargas and the manager.

Vargas helped calm down the mother and get her on the restroom floor, she said, and it was "a blessing" that paramedics from the East Fork Fire and Paramedic District arrived in time to assist in the delivery.

"The head of the baby was already out when she went to the floor," Vargas said. "The baby came out really, really fast. Fortunately, the emergency service people got here really fast."

Paramedics transported the mother and child to Carson Tahoe Regional Medical Center, where hospital spokesman Jon Tyler said he could only disclose that both are healthy. Their names were not released.

Vargas said the mother told her that she was 21 and had three other children. The mother was accompanied by a sister at the time, she added.

East Fork Battalion Chief Ron Haskins said paramedics have delivered babies in odd places, but it's the first birth on a restaurant restroom floor that he can recall during his 30 years with the district.

"We've delivered babies in cars and restrooms at home, but it's all part of the job," he said. "It's one of the most positive parts of our job."

When she entered the business, Vargas said, the mother was "screaming real bad, 'I'm in labor. I'm going to have it right now.' My manager said, 'What should we do?' I said, 'It's an emergency and we have to do something.'

"He and I grabbed Subway wrappers and trash bags and rags that we use in here, and put them on the restroom floor so there was sanitation. Everything happened so fast," she added.

After the birth, the 30-year-old Vargas held the mother's hand and assured her the boy was healthy. The mother reacted by "crying a bit but seemed to be OK," she said.

Vargas said though she's "really happy" about how things turned out, she urged her boss to provide training to employees on how to deliver babies.

Rural/Metro reached the agreement-in-principle on the terms of a prearranged financial restructuring plan with the majority of its senior lenders and approximately two-thirds of its bondholders. To implement the plan, Rural/Metro has elected to file Chapter 11 petitions in the U.S. Bankruptcy Court for the District of Delaware. Bernice Tingle liquidated her IRA to invest with a scam artist.

Bay Area resident Bernice Tingle was always an overachiever when it came to saving money. She accumulated more than $1 million by the time she retired at age 45 in 1991. By 2003 she had her 94-year-old mother move in with her as she was her mother's chief caretaker. Being her mother's "long-term care plan," Tingle was concerned about rising health care costs and was looking for a way to make more money.

When she met Maurice Michael McCant in 2007, he presented himself as a successful CEO of Billionaire Catt Entertainment, a rap concert promotion business, and promised to deliver more than 25 percent returns by investing in his company. After seeing these high returns on initial investments, she decided to liquidate her entire individual retirement account and other savings totaling $1.3 million and invest with McCant. It was a disaster.

"For a little over a year, monies were coming in like they were supposed to and allowing me to sustain," Tingle told?CNBC's "American Greed." "Then it was cut off and then I was just left there."

In total, McCant scammed 15 investors like Tingle out of their money. His take?more than $2 million. In 2011, he was convicted of wire fraud and sent to prison for just under four years.

Tingle lost her savings to McCant's scam, but that was not all. Next, the IRS and the state of California's Franchise Tax Board demanded Tingle pay substantial tax penalties accrued because of cashing out her IRA, which McCant had promised to pay himself but of course he didn't.

Tingle feels like she was victimized twice: "Even if I live to be as old as my mother, I will never be able to meet that tax bill obligation," she said.

She is not alone in dealing with tax liabilities because of losses in financial scams.

According to the IRS, thousands of victims of financial scams and identity theft fraud every year deal with potential tax implications. These victims can claim a "casualty and theft loss" deduction on their tax return to offset some of the losses from the fraud, however, which is often decided "based on the case facts and circumstances" by the IRS or the state tax board.

Of the two federal and state tax bills that Tingle received, almost 85 percent of her federal tax liability was forgiven as it was considered a "theft loss."

"The state is not looking at it that way. So that bill continues to tick, tick, tick, tick, tick," Tingle said, referring to the Franchise Tax Board.

Tingle's request for deductions via an amended tax return to the board was recently declined. CNBC asked the board for an updated, but it refused to discuss individual tax matters.

Protections for Ponzi scheme victims

In the wake of Bernie Madoff's Ponzi scheme at the end of 2008 when thousands of investors lost more than $60 billion, the IRS introduced guidance to relieve taxpayers suffering from losses because of financial fraud and Ponzi schemes.

"The provision to claim 'casualty and theft loss' deductions existed even before 2009, but the introduction of?IRS Rev. Ruling 2009-9 made the process and eligibility criterion easy to understand for everyone," said Carlos Guaman, a California-based accountant. He represents taxpayers in disputes with the IRS.

Specifically, this ruling serves as a guide to whether an individual's specific loss because of investments in fraudulent Ponzi schemes qualifies for a theft loss deduction for tax purposes or not.

Protect your identity

Identity theft and the resulting issuance of fraudulent tax refunds is also a?huge problem for the IRS as well as a burden on taxpayers.

For the 2010 tax year, $5 billion in tax refunds were issued by the IRS as a result of identity theft tax fraud according to a?report released by the U.S. Treasury Inspector General for Tax Administration. The report issued last year also estimates another $21 billion will be issued in potentially fraudulent tax refunds resulting from identity theft over the next five years.

Identity thieves may use your Social Security number to be paid by an employer or to file a fraudulent tax return for refunds like in the case of California resident Daniel Ramirez who has been a victim of identity theft.

At the end of 2011, Ramirez started receiving statements for maxed-out new store credit cards. On realizing that somebody has stolen his identity, he took the necessary steps of?informing the credit bureaus and?freezing his credit accounts temporarily. While most people stop there, Ramirez went beyond that and even filed an?Identity Theft Affidavit, Form 14039 with the IRS envisioning potential tax fraud issues.

Yet, when Ramirez tried to file his tax return online in April 2012, the system refused to accept it. "The person who had stolen my identity filed the taxes before I could and they were claiming a refund of like $10,000," Ramirez said.

But thanks to Ramirez's forward thinking and filing the identity theft affidavit, the IRS had flagged his account and stopped the refund from going to the identity thief. Even though it took a "number of follow-up calls to the IRS and a whole year to process," Ramirez eventually received his due refund earlier this year.

"It [identity theft] was one of the worst things ever; I wouldn't wish that on anybody," Ramirez recalled. "Dealing with the IRS, having to close fraud credit card accounts, cleaning all that mess up was very stressful."

The IRS provided CNBC with data and other information, but a spokesperson declined to comment on individual cases.

2. Order a?tax account transcript from the IRS that verifies basic personal data along with details of your tax return filed, which may come in handy if you are checking to see whether someone else filed a fraudulent return on your behalf

The?Federal Trade Commission also lists several steps you must take if you have been a victim of identity theft.

Gay marriage is legal, but wedding industry stuck in old ways

Many same-sex Bay Area couples planning their marriages are finding a wedding industry in tumult, as businesses built on the tradition of marriage between one man and one woman are forced to confront a new landscape.

While some businesses have embraced gay weddings, others still cling to marriage rituals that exclude same-sex couples, often turning what is expected to be an enjoyable experience into a frustrating and at times painful one.

"Every form you fill out, it says ?bride and groom.' But not every bride has a groom," said Lena Brancatelli, 32, of San Jose, who will marry her partner of nine years in September. "The wedding industry is very much heterocentric. It doesn't include same-sex couples."

The U.S. Supreme Court decision last month that effectively overturned California's same-sex marriage ban opened the door for thousands of people to enjoy the wedding planning rituals that have long been reserved for heterosexual couples. But the ruling has exposed a sharp divide in the industry that, except for a brief period in California's history, has adhered to the carefully scripted tradition of a white dress and tux, and lawfully wedded man and wife.

Most wedding websites, cards and invitations are designed for a man and woman, and business contracts and marketing materials are tailored to straight couples, say same-sex couples and gay marriage proponents. Couples say they are frustrated by venues that have only one bridal dressing room, the absence of women's clothes at tux shops and bakers that don't sell cake toppers representing same-sex couples.

Some wedding registries require listing the husband's last name, and most photographers don't have experience taking pictures of gay weddings, and using traditional wedding portrait poses with same-sex couples may make for awkward photos, according to wedding planning experts.

"There's just a whole lot of assumptions that go into a wedding based on how we've been programmed for centuries," said Bernadette Coveney Smith, a same-sex wedding expert in New York and founder of 14 Stories, a wedding planning firm that launched when same-sex marriage became legal in Massachusetts in 2004. "The industry, by and large, is incredibly old-fashioned and has a lot of work to do."

Renata Moreira, of San Francisco, who is planning a winter California wedding with Lori Bilella, said her caterer stopped replying to her emails after she requested a cake topper with two brides. Other couples share similar stories about businesses that stopped returning phone calls or suddenly changed their minds when they learned the wedding was same-sex.

"I would have enjoyed just being in the wedding planning instead of having this constant conversation about homophobia, rejection and exclusion," said Moreira, 36, who works at a San Francisco advocacy organization. "I feel like I'm teaching the industry. They're just not there yet."

Mandy Scott, a florist and wedding planner in San Francisco, said she had a surge of business when gay marriage was briefly legalized in 2008. Scott is ready to start booking same-sex weddings again, but she said she knows of a local florist who refused business from same-sex couples.

"We're supposed to be the groundbreakers here," she said. "But there are still people who are very entrenched in their beliefs."

Like Scott, many of the business owners who have welcomed same-sex weddings had some prior experience in 2008, when the state Supreme Court struck down California's ban on gay marriage and paved the way for more than 18,000 couples to marry before voters passed Proposition 8, restoring the ban.

Hotel Monaco in San Francisco hosted about 10 same-sex weddings before Proposition 8 passed and has booked two more for this year. Its parent company, Kimpton Hotels, is offering discounts on same-sex weddings, including 50 percent off for gay couples who book their reception before September. Since Kimpton Hotels was founded in San Francisco in 1981, the company has been a fundraiser and advocate for the gay community.

"We're pretty well-known as friends in the gay community," said Jason Stone, manager of Hotel Monaco.

After a five-year court battle, the U.S. Supreme Court on June 26 ruled that Proposition 8 supporters did not have the constitutional standing to defend the law in federal courts, effectively ending the state's ban on same-sex marriage. The court has rejected two subsequent appeals from Proposition 8 proponents. With that firmer legal footing, many same-sex couples are planning big events and investing in all the decorations, food and entertainment that was often left out of the more modest commitment ceremonies or the rushed weddings in 2008, when the looming passage of Proposition 8 left a narrow window to tie the knot.

"This is not a little throwaway party," said Kathryn Hamm, president of Gayweddings.com, an online directory of gay-friendly vendors.

Tim Lorenz and Ed Graziani are planning a "large-budget" wedding at the Marines' Memorial Club and Hotel in San Francisco that includes a sit-down dinner and custom-made tuxes. Lorenz, 49, said the venue -- a private hotel and social club run by U.S. Marines and veterans -- has "no qualms" about hosting a gay wedding.

"We never have come up against any kind of resistance," he said.

Some businesses have recognized the cash potential. Chardonnay Golf Club in Napa will host its first same-sex wedding this fall, when Brancatelli and fiancee Lisa Kirk get married there. Another couple is planning a wedding for December.

"From our perspective, it's good business," said General Manager Roger Billings. "In today's economy, I'm surprised that anyone is turning away business of any kind."

Casa Real and Palm Event Center, vineyards in Pleasanton under the same ownership, are offering special wedding packages for same-sex couples who want to marry this year. Marketing Director Michelle Peters said the industry can't afford to exclude any customers.

"We adapt as the market evolves," Peters said. Besides, she added, "They waited long enough."

Mexican bid to smuggle phone into prison in coffin

(AP) ? Mexico City prison authorities say they have quashed an attempt to smuggle a prohibited cell phone into a city prison in the coffin of an inmate's mother.

Prisoners in the city have the right to have the casket of a deceased parent or child brought into the prison yard so they can bid farewell to their relative.

But city correctional spokesman Emilio Castelazo said Friday that before the coffin was allowed into the Santa Marta Acatitla prison, guards searched the casket and found the cell phone inside.

Even those who have never rooted or ROM'd their phones have probably heard of CyanogenMod, the most widely used custom ROM for Android devices. The CyanogenMod software is so popular, that many times builds get ported to phones and tablets that are not officially supported by the CM developers.

If an Android device has enough of a following, and there are developer(s) willing to commit (no pun intended) to maintaining the device in the official CyanogenMod source tree, this device becomes officially supported -- and receives official builds of the CyanogenMod ROM. Official support not only gives owners a warm fuzzy feeling inside, but also less headaches as official builds are usually more stable and have fewer bugs.

(AP) ? Agencies are planning ways to get San Francisco Bay area commuters to work Monday if there's a transit strike, but officials say no matter what steps are taken there's no way to make up for the idling of one of the nation's largest transit systems

More ferries and buses will be put into operation to get people across San Francisco Bay. Carpool lanes will be open all day Monday, not just for rush hour. And gift cards for coffee will be handed out to drivers who pick up riders.

BART carries more than 400,000 commuters a day, keeping them off the roads in a region routinely choked with traffic.

"The inescapable fact is BART's capacity can't be absorbed by the other transit agencies," said John Goodwin, spokesman for the Metropolitan Transportation Commission. "We're still hoping for the best, but it's time to prepare for the worst."

Meanwhile, Bay Area Rapid Transit and its union were holding weekend-long labor talks in hopes of reaching an agreement by a midnight Sunday.

The two sides were scheduled to return to the negotiating table at 10 a.m. Saturday after recessing for the night Friday.

Key sticking points in the labor talks focused on worker safety, pensions and health care costs, commuters are bracing for what could be the second BART strike in a month.

When transit workers shut down train service for four days in early July, roadways were jammed and commuters faced long lines for buses and ferries. The unions agreed to call off that strike and extend their contracts until Sunday while negotiations continued.

"I didn't really fully appreciate the magnitude of disruption of my commute," said Oakland resident Benny Martin.

Martin, 32, said the short trip to his law firm in downtown San Francisco took him two hours each way. If BART workers strike next week, he just won't go into the office. "It's just not worth it for me."

A strike next week could cause more traffic mayhem than last month's work stoppage, which came around the Fourth of July holiday.

"Without having a holiday in the middle of the week, there's a potential for much greater congestion on the roadways," Goodwin said.

At a news conference Friday, Bay Area and state officials called on BART managers and union leaders to reach an agreement, saying a strike would create financial hardship for working families and hurt the Bay Area economy.

"We need an agreement and not a strike in our BART Service," San Francisco Mayor Ed Lee said. "They need to know that it is no longer a matter of inconvenience to the ridership. It is hardship."

On Thursday, two transit unions? which represent nearly 2,400 train operators, station agents, mechanics, maintenance workers and professional staff ? issued a 72-hour strike notice. They plan to participate in labor talks up until the contract expires at midnight Sunday in hopes of averting a strike.

At a meeting of BART's board Friday, union leaders urged the directors to give workers what they called a fair contract.

"I'm here to say we will not be busted," John Arantes, president of SEIU local 1021. "We are more united now than ever before."

BART General Manager Grace Crunican said the two sides were working hard at the bargaining table, but they remain far apart on wages, pensions and health care. There's still time to reach a deal before the strike deadline, she said.

"Three days is a long time when you've come as far as we have," Crunican told reporters.

Under state law, Gov. Jerry Brown has the authority to seek a court-ordered 60-day "cooling off period" that would temporarily block BART workers from striking.

"The governor is considering all his options and closely monitoring the situation," said spokesman Evan Westrup.

Union leaders urge governors to support 'Made in America' legislation

With the sound of jackhammers in the distance, union activists urged the nation's governors to support the creation of jobs in this country, and back "Made in America" legislation.

Phil Neuenfeldt, president of the Wisconsin AFL-CIO, told supporters gathered at Zeidler Union Square Park that it was time for a "jobs dialog" with governors. He implored governors to put aside partisan politics "and think about the average worker."

"Let's keep jobs here in Wisconsin and here in America," Neuenfeldt said.

Heath Verbockel, a member of the United Steelworkers and a paper worker for Appleton Coated, said he had seen mills close in Wisconsin. "Six hundred jobs went out the door" at one plant, he said.

Those jobs can endure in Wisconsin, he said, if Gov. Scott Walker directed state government to buy only paper products made in the state.

"If we make it here, let's buy it here," Verbockel said.

Tom Evenson, a Walker spokesman, did not directly address the paper issue, but issued this statement in response.

"Gov. Walker's number one goal is helping the private sector create Wisconsin jobs. After losing nearly 134,000 jobs in the four years before Gov. Walker took office, Wisconsin has gained over 62,000 private-sector jobs in the first two years of his term. This is the best two-year job gains of any governor in over a decade. We're heading in the right direction."

A number of unions were represented at the rally, held just blocks from the Wisconsin Center where the National Governors Association is meeting this weekend. Unions included the United Steelworkers, AFSCME, the Milwaukee Teachers Education Assocation, the United Food and Commercial Workers, the United Auto Workers, Wisconsin Building and Trades, and the National Association of Letter Carriers.

Meghan McKeefry, a field coordinator with the Alliance for American Manufacturing, said growth in the nation's manufacturing sector was vital to a stronger economy.

"American workers deserve a first shot at rebuilding America's infrastructure," she said.

The alliance, which tracks manufacturing jobs in Wisconsin and around the country, reports that 40,000 manufacturing jobs were lost in the state in the last decade.

Steve Breitlow, the business manager for Plumbers Local 75 of the Wisconsin Building and Trades, said rebuilding roads, highways and bridges were critical to long-term economic growth.

"We hope the NGA hears us loud and clear," Breitlow said.

At the rally, union organizers also sought signatures on petitions to Walker and other elected representatives. The petitions ask officials to support the right of all workers to have a union.

"Any attack on union members is a direct attack on the middle class families of Wisconsin who are already struggling to survive in this economy," the petition stated.

Chipley- To have called this a 'strange growing season' for panhandle farmers would be an understatement.

"You'll have wet years, you'll have dry years. This year, in one growing season we've had both, and that's what makes it even more unusual. It's unusually wet by itself. But then, if you look at how dry it was at planting time, it just makes it an even stranger situation" Washington County Agriculture agent Mark Mauldin said.

Washington County has been known for its watermelon crops, but not this year. This year's yields were drastically lower than last years'.

"Well, if you talk about watermelon just specifically, you could probably say about 70% less. If you want to talk about cantaloupe, its probably 95% less" Orwat said. He told us rain was the overriding factor accounting for the failure.

"They started in early July with all the heavy rains we've been having and that caused the vines to rot in low lying spaces. So, the majority in this county- Washington County, and Holmes County -a lot of the watermelon and cantaloupe crop was just decimated and ruined because of the vine rotting and the standing water."

Some grower got lucky and got a first cut,- some even a second. But many didn't even get the first one.

"You know, watermelons and cantaloupes you can get a lot out of a small acreage, so what's happened is those small acreage crops are high dollar value per acreage so it does hurt the crop" Orwat said.

And while many farmers lost their crop, Orwat said they didn't lost their hope.

"They could, you know, plant some vegetables in for a fall crop, late august early September."

And, some of those farmers may qualify for disaster relief funds from FEMA, due to the recent flooding.

Google Scientists Want Google to Stop Funding Climate Change Denial

In 2011, Google launched the Google Science Communication Fellows program, hiring 21 "early to mid-career Ph.D. scientists nominated by leaders in climate change research and science-based institutions across the U.S." On July 11, they threw a fundraiser for the reelection campaign of Senator James Inhofe (R-OK), a man who loudly dismisses climate change as a hoax.

Something, as they say, had to give.

A strongly worded letter, signed by 17 of those 21 outstandingly intelligent fellows, found its way to Google CEO Larry Page and executive chairman Eric Schmidt. In it, the Google scientists blast their company for its opportunistic affiliation:

Among his most notorious statements, Senator Inhofe has outrageously claimed that climate change is "a hoax on the American people" and, in the absence of a shred of factual evidence, accused climate scientists of being "criminals."

Given Google's commitment to educating the public about climate change, why would the company align its political efforts with Inhofe? In responding to criticism, a Google spokesperson acknowledged "while we disagree on climate change policy, we share an interest with Senator Inhofe in the employees and data center we have in Oklahoma."

But Inhofe's assault on the scientific community is not a difference in climate policy; it's a strategy designed to promote dysfunction and paralysis; to destroy the reputation of scientists and the legitimacy of their institutions; and to undermine our ability to find common ground.

Google doubled the size of that data center in Oklahoma last year, raising their investment in the state to $700 million, so it's not shocking that their interests align somewhat with Inhofe's. But according to Data Center Knowledge, in "an effort to make more renewable energy available to the regional grid, Google has also entered into a long-term agreement to purchase all of the energy from NextEra Energy Resources" Minco II wind facility. Whose side are you on, Google?

Google's own employees aren't the only ones publicly shaming the Internet giant, of course. A grassroots effort has produced several petitions on the matter and racked up thousands upon thousands of signatures. The activist website SumOfUs painted a stark picture of the flow of Google's money, not just to Inhofe but into the coffers of junk science organizations:

Earlier this month, Google hosted a $2,500-a-plate fundraiser for one of the world's most powerful climate change deniers, Senator Jim Inhofe. And just two weeks before that, Google poured $50,000 into the coffers of the Competitive Enterprise Institute, a right-wing think tank that is also funded by the likes of the Koch brothers and ExxonMobil to put out faux "studies" that are used by policy-makers to deny climate change exists.

Meanwhile, CREDO Action noted that Inhofe's climate position is hardly his sole failing as a political leader; he's "also anti-women's rights, anti-labor, anti-internet freedom, anti-LGBT rights, anti-Obamacare, anti-gun control, anti-immigration reform, pro-fracking and pro-war." Not exactly in keeping with Google?s corporate slogan, "Don't be evil," which petitioners have repurposed as the rallying cry "Don't fund evil."

The event is scheduled for 8 p.m. at The Waterfront in Manhattan, and in addition to the demonstration, Forecast the Facts wants activists to flood social media with "the #MeetMotoX and #DontFundEvil hashtags to spread awareness that Google's new 'hero phone' is financing anti-science villains."

Between the NSA revelations and missteps like these, it often seems that Google has lost the sheen of a new, cuddly, California-liberal sort of company and begun to symbolize a troubling status quo. What's more, customers are beginning to realize that the Internet is no longer just a big idea ? it's big business.

Juan Martin Del Potro: Will play Tommy Haas in the semi-finals

Top seed Juan Martin Del Potro saw off Kevin Anderson to book a semi-final showdown against Tommy Haas at the Citi Open in Washington.

Del Potro - looking to claim a third title in Washington - was in commanding form as he recorded a 7-6 (7/0) 6-3 victory over big-serving South African Anderson.

The Argentine was particularly impressive on his own delivery, not facing a single break point throughout the 1 hour 45 minute encounter.

Del Potro stepped up a gear to roll through the first-set tie-break without losing a point, part of a run that saw him win 15 points in a row - including six at the start of the second set which secured him the first break of the contest.

He would go on to close out the match with ease and now faces Haas, who he has beaten in each of their four previous encounters.

It's a good opportunity to reach another final but I have to beat a very good player," Del Potro said afterwards. "He's playing good this season and he has got a lot of experience. I'll try to play like today or even better."

Of the victoiry over Anderson, he added: "I just tried to return his serves and find a way to break. In the second set I broke very early and played with more confidence the rest of the match."

Haas also advanced with a straight sets win, but was made to battle all the way before completing a 7-6 (7/5) 7-6 (7/3) victory over Bulgaria's Grigor Dimitrov.

A tight contest yielded not a single break of serve although it was Dimitrov who had more chances, securing five break points to Haas' one.

Difficult opponent

But he could not make the opportunities count and Haas ultimately progressed to secure a shot at Del Potro.

"Del Potro is one opponent I despise playing in many ways," Haas said afterwards. "He has given me a lot of trouble. And he has been playing terrific tennis.

"It's going to be a challenge. I hope I can mix it up, play aggressive and not give him too many points."

Home favourite John Isner ensured there is still some American interest in the tournament as he came from a set down to beat Cyprus' Marcos Baghdatis.

In-form Isner claimed the seventh ATP Tour of his career in Atlanta last week and remains on course to make it back-to-back successes after a 6-7 (5/7) 6-4 6-4 win.

"I was pretty confident even though I lost the first set," Isner said. "I know I'm not going to win every tie-breaker. I was in a good rhythm and serving well.

"I wanted to make him beat me. I didn't want to lose my mind out there and I held it together pretty well over the last two sets."

Isner now faces Dmitry Tursunov in the last four after the Russian outlasted Australia's Marinko Matosevic 6-3 4-6 7-6 (7/4).

(AP) ? The United States issued a global travel alert Friday, citing an al-Qaida threat that also caused the State Department to close 21 embassies and consulates this weekend in the Muslim world.

The State Department warned American citizens of the potential for terrorism particularly in the Middle East and North Africa, with a possible attack occurring or coming from the Arabian Peninsula.

"Current information suggests that al-Qaida and affiliated organizations continue to plan terrorist attacks both in the region and beyond, and that they may focus efforts to conduct attacks in the period between now and the end of August," the statement said.

It urged American travelers to take extra precautions when traveling overseas and suggested they sign up for State Department alerts and register with U.S. consulates in the countries they are visiting.

The alert was posted a day after the U.S. announced it would close diplomatic facilities on Sunday because of an unspecified threat. Spokeswoman Marie Harf said the department acted out of an "abundance of caution" and that some missions may stay closed for longer than a day. Sunday is a business day in Muslim countries. The diplomatic offices affected stretch from Mauritania in northwest Africa to Afghanistan.

Rep. Ed Royce, R-Calif., chairman of the House Foreign Affairs Committee, said Friday the embassy threat was linked to al-Qaida and focused on the Middle East and Central Asia.

"We've had a series of threats," Royce told reporters. "In this instance, we can take a step to better protect our personnel and, out of an abundance of caution, we should." He declined to say if the National Security Agency's much-debated surveillance program helped reveal the threat.

Rep. C.A. Dutch Ruppersberger of Maryland, the top Democrat on the House Intelligence panel, also supported the department's decision to go public with its concerns.

"The most important thing we have to do is protect American lives," he said, describing the threat as "not the regular chit chat" picked up from would-be militants on the Internet or elsewhere.

The State Department issued a major warning last year informing American diplomatic facilities across the Muslim world about potential violence connected to the anniversary of the Sept. 11 terrorist attacks.

Dozens of American installations were besieged by protests over an anti-Islam video made by an American resident.

In Benghazi, Libya, the U.S. ambassador and three other Americans were killed when militants assaulted a diplomatic post, but the administration no longer says that attack was related to the demonstrations.

Friday's alert warned that al-Qaida or its allies may target U.S. government or private American interests. It cited dangers involved with public transportation systems and other prime sites for tourists, noting that previous terrorist attacks have centered on subway and rail networks as well as airplanes and boats.

"U.S. citizens should take every precaution to be aware of their surroundings and to adopt appropriate safety measures to protect themselves when traveling," the department said. It recommended American traveling overseas register with consular authorities on a travel registration website. The alert expires on Aug. 31.

Ruppersberger said the U.S. has invested greatly in research and protection system for U.S. embassies and citizens since the Benghazi attack.

"Intelligence is probably the best defense against terrorist attacks," he said. "Intelligence isn't always an exact science, but you have to react and you have to prepare. So we put people on notice and we also put the other side on notice."

Rep. Adam Schiff of California, another Democrat on House intelligence, said he was briefed on the matter this week and called the State Department's decision to close embassies a "prudent" step.

"I hope it will be of short duration," he said.
