HOUSTON ? A Harris County man alleges ITT fired him because he has cancer, recent court papers show.?
Derek Holloway sued the for-profit school last month in Harris County District Court.
The litigation was removed to the Houston Division of the Southern District of Texas on May 7.
ITT hired Holloway as an educational recruiter in July 2009.
He was diagnosed with prostate cancer on Oct. 15, 2012, and a week later, went on disability leave to undergo extensive radiation treatments.
His superiors knew about his illness and the need for him to take leave, but nonetheless fired him shortly afterwards, the original petition says.
It adds the school?s purported acts equal to discrimination against Holloway ?in the compensation, terms, conditions and privileges of his employment based upon [him] being disabled, being regarded as disabled and having a record of being disabled.?
Consequently, the complainant sues for back and front pay, lost benefits and the reinstatement to his position.
