KBR Inc. may be at risk for government penalties related to allegations that employees took kickbacks from military contracts overseas, Reuters reported.
The government joined a whistleblower lawsuit in 2010 that alleged employees in the transportation department of Houston-based KBR (NYSE: KBR) took 317 separate kickbacks for military contracts in Iraq, Afghanistan and Kuwait, worth around $46,000.
The company argued that it should not be held liable for employees' actions ? judges could penalize the company at twice the value of each kickback.
In a federal appeals court Friday, the U.S. Circuit Court of Appeals for the Fifth Circuit said that KBR could, in fact, be found liable for employees' actions under the Anti-Kickback Act.
KBR is a global engineering, construction and services company supporting the energy, hydrocarbon, power, industrial, civil infrastructure, minerals, government services and commercial markets.
KBR was one of 26 Houston-area companies that made the Fortune 500 list this year. The company had $7.9 billion in revenue.
In May, KBR won a contract to provide engineering services for a liquified natural gas export facility in Canada.
